By using this website, you signify your consent to these terms of use. If you do not agree to these Terms of Use, please do not use the website. By purchasing a product, you (herein referred to as ‘Client’) agree to the following terms stated herein. Your access to and use of this website, as well as all related websites operated by Ruqayya Daville (collectively the ‘Site’), is subject to the following terms and conditions (‘Terms of Use’) and all applicable laws. By accessing and browsing the 'Site', you accept, without limitation or qualification, the Terms of Use and acknowledge that any other agreements between you and the 'Site' are superseded and of no force or effect. We reserve the right to change these Terms and Conditions or to impose new conditions on the use of the' Site', from time to time, in which case we will post the revised Terms and Conditions on this website. By continuing to use the 'Site' after we post any such changes, you accept the Terms and Conditions, as modified.

Anyone may access the' Site', for which no personal data are collected, meaning that visitors may stay anonymous. However, if visitors/users wish to use certain services or products, whether paid or unpaid, they may have to leave personal data. We assure the users that any leaving of personally identifiable data will be dealt with in accordance with the highest privacy standards and in line with the General Data Protection Regulation (hereinafter referred to as ‘GDPR’), and our Terms and Conditions and Privacy Policy.

The Company assumes no liability or responsibility for any errors or omissions in the content of the 'Site'. We will do our best to ensure all facts and statements on this site and in our materials are true and correct to the best of our knowledge. We will do our best to ensure all facts and statements in our work do not infringe upon any copyright or other right of a third party.

However, Ruqayya Daville can’t be liable to you, or any third party, for any special, incidental, indirect, punitive, reliance or consequential damages, whether foreseeable or not, including, but not limited to damage or loss of property, equipment, information or data, lost profits, lost savings or loss of revenue, cost of replacement services, cost of capital, complaints, claims, litigation or other incidental, consequential, or special damages which may arise from your use of the 'site or your relationship with Ruqayya Daville. The foregoing applies even if Ruqayya Daville was advised of the possibility of or could have foreseen the damages.

Intellectual Property

The 'Site' contains intellectual property owned by Ruqayya Daville or used with permission by, the Company. including, without limitation, trademarks, copyrights, proprietary information, and other intellectual property as well as the Ruqayya Daville name, logo, all design, text, graphics, other files, and the selection and arrangement thereof.

Subject to your compliance with these Terms of Use, the Company hereby grants you a limited license, which is non-exclusive, non-transferable, and non-sublicensable, to access, view, and use the 'Site' solely for your personal purpose use and all content belongs solely to Ruqayya Daville.

You may not copy, modify, republish, uploaded, transmit, participate in the transfer or sale of, create derivative works from, distribute, display, reproduce or perform, or in any way exploit in any format whatsoever any of the 'Site' content or intellectual property, in whole or in part without our prior written consent. You agree that such Company Content shall include all proprietary videos, HTML/CSS, JavaScript, graphics, voice, and sound recordings, artwork, photos, documents, and text as well as all other materials included in the 'Site', excluding only the materials you provide.

The Company has the right but has no obligation, to remove content and accounts containing materials that it deems, in its sole discretion, to be unlawful, offensive, threatening, libellous, defamatory, pornographic, obscene or otherwise objectionable or violates any party’s intellectual property or these Terms of Use. If you believe that your intellectual property rights are being violated and/or that any work belonging to you has been reproduced on the 'Site' or in any Content in any way, you may notify the Company at ruqayya@ruqayyadaville.com. Please provide your name and contact information, the nature of your work and how it is being violated, all relevant copyright and/or trademark registration information, the location/URL of the violation, and any other information you believe is relevant.

If you send comments or suggestions about the 'Site' to the Company, including, but not limited to, notes, text, drawings, images, designs or computer programs, such submissions shall become, and shall remain, the sole property of the Company. No submission shall be subject to any obligation of confidence on the part of the Company. The Company shall exclusively own all rights to (including intellectual property rights thereto) and shall be entitled to unrestricted use, publication, and dissemination as to all such submissions for any purpose, commercial or otherwise without any acknowledgement or compensation to you.

The company shall not be responsible for any performance or service problems caused by any third-party website or third-party service provider. Any such problem shall be governed solely by the agreement between you and that provider. Please note that the applicable jurisdiction may not allow the exclusion of implied warranties. Some of the above exclusions may thus not apply to you.

Commerce

You are encouraged to familiarise yourself with your rights contained within the Sale of Goods Act 1979, Unfair Contract Terms Act 1977 and the Unfair Terms in Consumer Contracts Regulations 1999. the 'Site' may offer goods or services (“product”) for sale on behalf of Ruqayya Daville. By placing an order through the ‘Site’  you are offering to purchase a product or service subject to these Terms and Conditions. By submitting such information, you grant us the right to provide the information to third parties for purposes of facilitating the completion of purchases. All orders are subject to availability. Delivery times may vary according to availability and are subject to any delays resulting from postal delays or force majeure for which Ruqayya Daville will not be responsible.

To contract with Ruqayya Daville through www.ruqayyadaville.com you must be over 18 years of age and possess either an account with PayPal, Stripe or a valid credit or debit card issued by a bank acceptable to us. Ruqayya Daville and the 'Site' retain the right to refuse any request made by you. When placing an order, you undertake that all details you provide to us are true and accurate, that you are an authorized user of the PayPal account or credit, or debit card used to place your order and that there are enough funds to cover the cost of the product or services.

All prices advertised are subject to such changes. Before placing any order, you will be asked to accept these terms and conditions. A contract between us will be formed after you have clicked the appropriate box to indicate your acceptance of the terms and conditions and tendered your payment.

If Client elects to pay in monthly or quarterly instalments, Client authorises the Company to charge Client’s credit card or debit card. If the Client elects to pay in FULL, the Client may pay by credit card or debit card.

If you sign up for a product or service that has a payment plan, you are liable to pay the full amount of the payment plan, whether you continue with the product or service or not.

If the client buys a product or program with ‘lifetime access’, this is for the lifetime of the product or program, not the lifetime of the client. The Company reserves the right to cancel products and programs but commits to giving at least 6 months' notice of such terminations to the Client.

Each product is for individual registration only. Access will be cancelled if more than 1 person is found using the product and a refund will be denied.

Availability Inaccuracies & Errors

While we try and ensure that all details, descriptions, and prices which appear on this 'Site' are accurate, errors may occur. If we discover an error in the price of any goods which you have ordered, we will inform you of this as soon as possible and give you the option of reconfirming your order at the correct price or cancelling it. If we are unable to contact you, we will treat the order as cancelled. If you cancel and you have already paid for the goods, you will receive a full refund.

Refund Policy

All sales are final. We do not accept returns. Once the product you have purchased has been delivered to you, or you have begun to access the online course or coaching program no refunds will be made available.

Cancellation Appointment +Event Policy

We know your time is valuable, and ours is too. Cancellations made [7] days or more in advance of the [Appointment] date will be rescheduled or for an online [event] will receive a 50% refund. Cancellations made less than [7] days will not receive a refund. Any concerns then please notify ruqayya@ruqayyadaville.com.

Additional Charges

Delivery costs, if any, will be charged in addition; such additional charges are clearly displayed where applicable and included in the ‘Total Cost’. Any additional charges such as taxes, if any, will also be displayed before you are asked to submit payment. Upon receiving your order, we carry out a standard authorization check to ensure your payment method is valid and your payment will be processed. Once we are certain of your payment being processed your order will be fulfilled. We reserve the right to refuse or cancel your order at any time for certain reasons including but not limited to product or service availability, errors in the description or price of the product or service, error in your order or other reasons. You expressly agree that Ruqayya Daville cannot accept any liability for loss or damage arising out of such cancellation. We reserve the right to refuse or cancel your order if fraud or an unauthorized or illegal transaction is suspected.

Termination

The company also reserves the right to limit your use of the site and/or the content or to terminate your account should the company determine that you have violated these terms of use, or that you have violated any other rules or conditions of the company. The company reserves the right to refuse access to the site and/or the company’s content, products and/or services to anyone at its sole discretion.

The company reserves the right to determine, in its sole discretion, whether the company is responsible for any such malfunction or disruption. The company may, in its sole discretion, refund the initial fee charged for any use of the site and/or any content or a pro-rata portion thereof consistent with the company’s refund policy. The company shall refuse any refund thirty (30) days after your payment for use of the site and/or any content, either pursuant to the company’s customer license agreement or otherwise, regardless of the reason for disruption.

Upon termination, your right to use the Service will immediately cease. All provisions of the Terms which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

Indemnification

You agree to indemnify and hold the Company and each of its directors, officers employees, and agents, harmless from any and all liabilities, claims, damages and expenses, including reasonable attorney’s fees, arising out of or relating to (i) your breach of this Agreement, (ii) any violation by you of law or the rights of any third party, (iii) any materials, information, works and/or other content of whatever nature or media that you post or share on or through the Site, (iv) your use of the Site or any services that the Company may provide via the Site, and (v) your conduct in connection with the Site or the services or with other users of the Site or the services. The Company reserves the right to assume the exclusive defence of any claim for which we are entitled to indemnification under this Section. In such event, you shall provide the Company with such cooperation as is reasonably requested by the Company.

The company does not warrant or make any representations regarding the use of the materials in the site, the results of the use of such materials, the suitability of such materials for any user’s needs or the likelihood that their use will meet any user’s expectations, or their correctness, accuracy, reliability, or correction. The company likewise does not warrant or make any representations or guarantees that you will earn any money using the site or the company’s technology or services. Your earning potential is entirely dependent on your own products, ideas, and techniques; your execution of your business plan; the time you devote to the program, ideas and techniques offered and utilised; as well as your finances, your knowledge and your skill. The company does not warrant that use of the materials will be uninterrupted or error-free that defects will be corrected, or that this site, the content, and/or the materials available on this site are free from bugs or viruses or other harmful components. You assume all responsibility for the cost of all necessary repairs or corrections.

The Agreement

These Terms and Conditions, along with any Disclaimer and Privacy Policy posted on 'the site' constitutes the entire agreement between you and Ruqayya Daville pertaining to the Site and supersedes all prior and contemporaneous agreements, representations, and understandings between us. No waiver of any of the provisions of these Terms and Conditions by Ruqayya Daville shall be deemed or shall constitute, a waiver of any other provision, whether or not similar, nor shall any waiver constitute a continuing waiver. No waiver shall be binding unless executed in writing by Ruqayya Daville.

This agreement is governed by the laws of England & Wales, whose courts shall have sole jurisdiction in relation to all matters arising. The provisions of these Terms of Use are for the benefit of the Company, its subsidiaries, affiliates and its third-party content providers and licensors, and each shall have the right to assert and enforce such provisions directly or on its own behalf.
